2. Services
Sites by Doug provides:
- Website design and development
- Website hosting (via third-party providers)
- Website maintenance plans
- Digital marketing services
- Project-based and retainer-based work
All services are provided subject to agreement on scope, timelines, and pricing.
3. Payments
3.1 Deposits
- A 50% non-refundable deposit is typically required before work begins.
- The remaining balance is due upon project completion or as otherwise agreed.
3.2 Retainers
- Monthly retainer services may be offered at our discretion.
- Retainers must be paid in advance unless otherwise agreed.
3.3 Late Payments
- Failure to make payment may result in suspension or termination of services, including taking websites or associated services offline.
- Services will be reinstated only after outstanding balances are cleared.
4. Cancellations
4.1 By the Client
- Projects may be cancelled at any time.
- Deposits are non-refundable if the client cancels.
4.2 By Sites by Doug
- We reserve the right to cancel a project at our discretion.
- In such cases, any deposit paid will be fully refunded.
5. Intellectual Property
5.1 Ownership
- Upon full payment, the client owns the final website and its assets.
5.2 Portfolio Rights
- Sites by Doug retains the right to showcase completed work in portfolios, marketing materials, and case studies.
- Clients may request exclusion from portfolio use, which may incur an additional fee.
5.3 Reuse of Components
- We reserve the right to reuse general code structures, frameworks, and non-client-specific elements across projects.
6. Hosting & Third-Party Services
Websites may be hosted via third-party providers such as SiteGround.
- We are not responsible for downtime, outages, or issues caused by third-party providers.
- If a client moves hosting away from Sites by Doug:
- Ongoing services (e.g. email systems, integrations, booking systems) may cease to function.
- The new provider is fully responsible for migration and setup.
- Any support or guidance requested after leaving will be billable.
7. Scope of Support
7.1 Hosting & Maintenance
Basic hosting and maintenance includes:
- Keeping the website live and operational
- Maintaining essential functionality
- Supporting included email services
7.2 Out-of-Scope Work
The following are not included unless agreed separately:
- Content updates
- Design changes
- Feature additions or removals
- Ongoing content creation
All such work is chargeable based on scope and urgency.
8. Client Responsibilities
Clients are responsible for:
- Providing accurate and lawful content
- Ensuring their business complies with applicable laws and regulations
- Reviewing and approving deliverables
We do not verify or validate the legality, performance, or viability of a client’s business model, strategy, or requested features.
9. Limitation of Liability
To the fullest extent permitted by law:
- Sites by Doug shall not be liable for any loss of revenue, profit, business, or indirect damages.
- We are not responsible for the outcomes or performance of any website or marketing activity.
- Any decisions based on work delivered are the client’s responsibility.
10. Acceptable Use
We reserve the right to refuse or terminate services if a client:
- Requests unlawful, harmful, or infringing content
- Engages in abusive or unreasonable conduct
- Fails to meet payment obligations
11. Data Protection & Privacy
We process personal data in accordance with UK GDPR. Please refer to the Privacy Policy below.
12. Changes to Terms
We may update these Terms at any time. Continued use of our services constitutes acceptance of any updates.
13. Governing Law
These Terms are governed by the laws of England and Wales.
